Terms of Service

Acceptance of Terms

By downloading, installing, or using any mobile application published by Dunking Dog Games (collectively, the “Apps”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use our Apps.

These Terms apply to all users, visitors, and anyone else who uses or accesses the Apps. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Apps after any changes constitutes your acceptance of the new Terms.

Intellectual Property Rights

The Apps, including but not limited to their code, graphics, photographs, animations, video clips, electronic markers, sounds, music, texts, and compiled code, are the property of Dunking Dog Games or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You agree that you will not:

  • Copy, modify, or create derivative works of any part of the Apps
  • Reverse engineer, decompile, or attempt to extract the source code
  • Translate the Apps into other languages
  • Remove any proprietary notices or labels from the Apps
  • Use our trademarks, logos, or brand names without explicit written permission

All intellectual property rights in the Apps remain exclusively with Dunking Dog Games.

License Grant

Subject to these Terms, Dunking Dog Games grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install one copy of the App on each device you own or control
  • Use the App for your personal, non-commercial entertainment purposes
  • Access and use features available within the App

This license does not include any right to resell, sublicense, distribute, or commercially exploit the App in any way.

User Responsibilities

You are responsible for:

  • Maintaining the security of your device and access credentials
  • Ensuring your device meets the minimum system requirements
  • Complying with all applicable laws and regulations in your jurisdiction
  • Not using the Apps for any unlawful or unauthorized purpose

Device Security

We recommend that you do not jailbreak, root, or modify your device’s operating system, as this may:

  • Compromise your device’s security
  • Void your warranty
  • Cause the App to malfunction or stop working entirely
  • Violate these Terms of Service

Internet Connectivity

Many features of our Apps require an active internet connection. You acknowledge that:

  • Data charges may apply when using mobile data networks
  • Dunking Dog Games is not responsible for data charges incurred by your use of the Apps
  • Roaming charges may apply when traveling internationally
  • App functionality may be limited without internet access
  • We are not liable for service interruptions due to connectivity issues

In-App Purchases and Payments

Some Apps may offer in-app purchases, subscriptions, or other paid features. By making a purchase:

  • You authorize us to charge your designated payment method
  • All sales are final and non-refundable unless required by law
  • Prices may change without prior notice
  • Promotional pricing may be time-limited

User Content

Some Apps may allow you to submit, upload, or share content (“User Content”). By submitting User Content, you:

  • Retain ownership of your content

  • Represent that you have all necessary rights to submit the content
  • Agree not to submit illegal, harmful, or infringing content

We reserve the right to remove any User Content at our sole discretion.

Termination

We may terminate or suspend your access to the Apps immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

  • Your license to use the App ends immediately
  • You must delete all copies of the App from your device
  • Provisions that should survive termination will continue in effect

Disclaimer of Warranties

THE APPS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. DUNKING DOG GAMES DOES NOT WARRANT THAT:

  • THE APPS WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • THE APPS WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS
  • THE QUALITY OF THE APPS WILL MEET YOUR STANDARDS
  • ANY RESULTS FROM USING THE APPS WILL BE ACCURATE OR RELIABLE

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUNKING DOG GAMES SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, data, use, goodwill, or other intangible losses
  • Any damage to your device or data
  • Results obtained from using or inability to use the Apps

Our total liability shall not exceed the amount you paid for the App, if any.

Third-Party Services

Our Apps may integrate with or link to third-party services, including but not limited to:

  • Google Play Games (Android authentication and cloud saves)
  • Facebook Login (optional social features)
  • In-app advertising networks
  • Analytics providers

These services have their own terms of service and privacy policies. We are not responsible for the content, practices, or availability of third-party services.

Updates and Maintenance

We may update the Apps to:

  • Fix bugs and security vulnerabilities
  • Add new features and content
  • Improve performance and compatibility
  • Comply with legal requirements

You agree to accept updates when offered. We do not guarantee that updates will be provided indefinitely or that older App versions will remain compatible with future operating systems.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the appropriate courts.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by:

  • Updating the “Last Updated” date below

Your continued use of the Apps after changes constitutes acceptance of the updated Terms.
